Summary
Two Massachusetts sanctuary cities - the City of Chelsea and the City of Somerville - have filed a lawsuit against the Trump administration challenging Trump's executive orders targeting sanctuary cities. Upon returning to office, President Trump reinstated an executive order from his first term that instructed federal agencies to cut funding for cities that refuse to use municipal resources to enforce federal immigration laws. President Trump also issued Executive Order 14159, which orders fines and penalties against cities that resist his immigration agenda. The plaintiffs argue that President Trump's actions violate the separation of powers, the Spending Clause, the Tenth Amendment, and the Administrative Procedure Act; are void for vagueness; and violate the plaintiffs' Fifth Amendment Right to due process. The plaintiffs request that the court find Trump's threats against sanctuary cities unlawful and prevent sanctuary cities from being defunded and prosecuted for refusing to comply with Trump's immigration agenda.
