Summary
Make the Road New York, an immigrant advocacy group, sued the Trump administration in an attempt to block a clause of Executive Order 14159, "Protecting the American People Against Invasion," which expands the scope of the expedited removal process. Expedited removal is a process by which a migrant can be removed from the country without an immigration court hearing or an appearance before a judge, and has previously only been applied to migrants who entered the country without authorization and were apprehended within two weeks of their entry into the country, or within 100 miles of the U.S. land border. The executive order would allow expedited removal to be carried out against any migrant in the United States who cannot prove that they have resided in the country for more than two years. The plaintiffs have argued that the executive order is unconstitutional and ought to be rendered unenforceable.
