The Project on Government Oversight (POGO) has filed suit against President Trump and the Department of Government Efficiency (DOGE) challenging DOGE's claim that its records are subject to the Presidential Records Act (PRA) rather than the Freedom of Information Act (FOIA) and the Federal Records Act (FRA). POGO argued that although DOGE was established by executive order, DOGE functions as a federal agency, and is therefore obligated to make its records available to the public pursuant to FOIA and the FRA. POGO has requested that the court enter an injunction ordering DOGE, as well as the U.S. DOGE Temporary Service and the U.S. DOGE Service Temporary Organization, to comply with FOIA and the FRA.
